Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of the TCG Marketplace website, applications, and related services (collectively, the "Service"). By creating an account, browsing the platform, listing items, making purchases, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Platform Overview and Commercial Terms

TCG Marketplace operates an online marketplace for trading cards and collectibles. In most transactions between users, TCG Marketplace provides the platform, payment tools, and related marketplace services, but is not the buyer or seller and is not a party to the underlying sale contract between users.

If TCG Marketplace is clearly identified as the direct buyer or seller in a particular offer, listing, or program, then TCG Marketplace will be a party to that transaction and additional terms may apply.

2. Eligibility and User Accounts

You must be at least 18 years old to create an account and use the Service. You agree to provide accurate account information, keep your credentials confidential, and accept responsibility for activity under your account.

We may suspend, restrict, or terminate accounts that violate these Terms, create risk for the platform, or are used for fraud, abuse, or unlawful conduct.

3. Buyer Responsibilities

• Provide accurate shipping, billing, and contact information.
• Pay promptly when a purchase is confirmed.
• Inspect items on arrival and report issues within the applicable review window.
• Communicate honestly and in good faith with sellers and support.

Abusive chargebacks, false non-delivery claims, item swapping, or misuse of dispute tools may result in account restrictions or termination.

4. Seller Code of Conduct and Responsibilities

Sellers may only list items they lawfully own and are authorized to sell.

• Listings must accurately describe authenticity, condition, edition, and defects.
• Sellers must not list counterfeit, stolen, proxy, or infringing items.
• Confirmed orders must be shipped within 2 business days unless otherwise stated.
• Items must be packaged securely to reduce risk of damage in transit.
• Sellers must respond promptly to order and support inquiries.
• Shill bidding, price manipulation, ghosting, or off-platform fee avoidance are prohibited.

5. Payments, Fees, Payout Holds, and Fraud Prevention

Payments are processed by third-party providers such as Stripe and are subject to those providers' terms. TCG Marketplace may charge marketplace, processing, shipping, or other disclosed platform fees.

By selling on the Service, you authorize TCG Marketplace and its payment providers to hold or delay payouts, deduct refunds, chargebacks, return shipping costs, and fees from your available balance or future payouts, and recover amounts owed where seller fault, misrepresentation, non-shipment, fraud, or other policy violations occur.

Where allowed by law and payment-provider rules, TCG Marketplace may also recover losses from a connected payout or payment method if your balance is insufficient to cover obligations arising from your marketplace activity.

6. Seller Verification and Platform Enforcement

Certain selling features may require identity verification or additional review. TCG Marketplace may request documentation to verify identity, business information, or compliance with platform policies.

We may issue warnings, remove listings, delay payouts, limit account capabilities, or ban users entirely where we reasonably suspect fraud, counterfeiting, abusive behavior, or repeated policy violations.

7. Returns, Refunds, and Disputes

Buyers may be eligible for refunds when an item is not received, materially differs from the listing, is counterfeit, or arrives significantly damaged due to poor packaging. Additional details are available on our Returns & Refunds page.

TCG Marketplace may review order records, shipment tracking, photos, messages, and other evidence to resolve disputes and determine whether funds should be reversed or released.

8. User-Generated Content and License

You retain ownership of content you submit, including listing photos, descriptions, messages, usernames, and other materials. By posting content, you grant TCG Marketplace a worldwide, non-exclusive, royalty-free license to host, use, reproduce, modify, display, and distribute that content as necessary to operate, improve, market, and protect the Service.

9. Prohibited Activities

• Selling counterfeit, stolen, or illegal goods.
• Harassing, threatening, or abusing other users or staff.
• Manipulating prices, bids, feedback, or marketplace activity.
• Using bots, scraping tools, or unauthorized automation against the Service.
• Trying to bypass fees, restrictions, or enforcement actions.
• Violating intellectual property, privacy, or other third-party rights.

10. Intellectual Property

The Service and its original design, branding, software, and platform content are owned by TCG Marketplace or its licensors and are protected by applicable law. Trading card names, publisher marks, and related imagery belong to their respective owners and are used for identification and marketplace reference purposes only.

11. Privacy and Data

Your privacy is important to us. Our handling of personal information is described in our Privacy Policy. By using the Service, you agree to the collection, use, and disclosure of information as described there.

12. Suspension and Termination

TCG Marketplace may suspend, limit, cancel listings, reverse certain transactions, or terminate accounts at its discretion where necessary to protect users, comply with law, or enforce these Terms. You remain responsible for obligations tied to transactions that occurred before closure or termination.

13. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, TCG Marketplace disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, security, and uninterrupted availability.

14. Limitation of Liability

To the fullest extent permitted by law, TCG Marketplace will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill arising from or related to the Service.

If TCG Marketplace is found liable for any claim, our total liability will not exceed the greater of the fees you paid to TCG Marketplace in the 6 months preceding the event giving rise to the claim or $100 USD.

15. Indemnification

You agree to defend, indemnify, and hold harmless TCG Marketplace and its affiliates, officers, employees, and agents from claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your use of the Service, your listings or transactions, your content, or your violation of these Terms or applicable law.

16. Dispute Resolution and Arbitration

Before starting formal legal action, you agree to first attempt to resolve disputes through good-faith informal negotiations with TCG Marketplace. If a dispute cannot be resolved informally, it will be resolved on an individual basis through binding arbitration to the extent permitted by law, and not through a class or representative action.

17. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles, except where applicable law requires otherwise.

18. Changes to These Terms

We may update these Terms from time to time. Material changes may be communicated by posting the updated Terms on the site, sending an email, or displaying an in-product notice. Your continued use of the Service after the revised Terms take effect constitutes acceptance of the updated Terms.
